These terms and conditions contain the exclusively applicable provisions between Hadad GmbH, Ahltener Str. 15C, 31275 Lehrte, HRB 207190, Local Court of Hildesheim, unless modified by written agreement. They apply in particular to all concluded contracts as well as any use of the services provided by Hadad GmbH, especially tariff presentations, data record generation and/or delivery.

Customers within the meaning of these terms are consumers, i.e., natural persons with whom business relations are established, without attributing them to a commercial or independent professional activity. Entrepreneurs within the meaning of these terms are natural or legal persons or legally capable partnerships who, when entering into business relations, act in the exercise of a commercial or independent professional activity. Customers are both consumers and entrepreneurs. For contracts to be concluded and for the use of the applications, the user must be of legal age.

Amendments to these terms and conditions will be communicated in writing, by post, or by email. If the customer does not object within four weeks of receiving the notification, the changes are deemed accepted. In the event of amendments, the customer will be specifically informed of the right to object and the consequences of remaining silent.

Hadad GmbH itself, or with the help of third parties, provides users with paid but non-binding information about providers' tariffs and conditions, both online and offline.

Hadad GmbH mediates based on an offer submitted by the user, online or offline, to the respective provider. No obligations beyond contract mediation are assumed.

The search query with transmission of the user's personal data constitutes the offer to use the services of Hadad GmbH. It is only accepted once Hadad GmbH provides proposals based on the actual data transmitted. The user then receives various provider suggestions online, calculated according to the data entered. If the user chooses a specific proposal from Hadad GmbH, they may either request or submit an offer to conclude a contract with a provider online (via the designated button) or offline, based on the original proposal.

The data entered during comparisons is collected, processed, and if necessary, transmitted to selected providers by Hadad GmbH. Such data may also be stored and used by these providers or by Hadad GmbH for the purposes of creating comparisons, offers, further processing, customer service, and, if applicable, for credit checks (e.g., Schufa or other agencies). This includes sending specific offers and additional information by post, email, or phone. Due to provider-specific tariff structures and conditions, deviations between the providers' offers and Hadad GmbH's suggestions may occur.

A contract is concluded solely between the user and the provider selected by the user. Hadad GmbH has no influence on the conclusion or non-conclusion of such contractual relationships. Whether a contract is formed depends on the rules of the respective provider.

Providers' specific offers may, in individual cases, differ from the tariffs or conditions calculated and displayed by Hadad GmbH. The providers are solely responsible for the content and accuracy of their offers.

Hadad GmbH strives for constant accuracy, completeness, and timeliness in handling user data and conducting comparison calculations. However, it is not obliged to include all companies available on the market in its calculations.

Hadad GmbH assumes no liability for the timeliness, completeness, or accuracy of the comparison results, nor for the prompt, complete, and correct forwarding of data or transmission of offers/applications. This does not apply to damages caused by gross negligence or willful misconduct in contractual obligations or pre-contractual duties by Hadad GmbH, its partners, or its agents.

Any information provided by Hadad GmbH does not constitute advice but is intended solely to assist the user in making independent decisions. Hadad GmbH has no influence over such decisions. None of the information is to be understood as a guarantee or assurance. Hadad GmbH's services do not include legal or tax advice.

Claims for compensation for damages negligently caused through the use of Hadad GmbH's services are limited to €10,000, provided that effective insurance coverage exists.

Claims of users related to Hadad GmbH's services expire two years after the claim arises, but no later than two years after the termination of a contractual or quasi-contractual relationship with Hadad GmbH. This does not apply in cases of willful misconduct.

The input and transmission of personal data by the user take place online via input forms prepared by Hadad GmbH, or via other expressly designated transmission methods. The user is solely responsible for the completeness and accuracy of all data provided. If the user submits false, incorrect, or incomplete information, Hadad GmbH is entitled to disregard the search query. In the case of deliberately false or untrue data, Hadad GmbH reserves the right to exclude the user from services and claim compensation for damages.

The services of Hadad GmbH may only be used by private individuals or companies for purposes not attributable to commercial or independent professional activities. Use for commercial or professional purposes is strictly prohibited.

Any information provided by Hadad GmbH does not constitute advice but serves only to assist independent decision-making, over which Hadad GmbH has no influence. None of the information constitutes a guarantee or assurance. The services of Hadad GmbH do not include legal or tax advice.

All copyrights, usage rights, and other protective rights remain with Hadad GmbH.

For each violation of the prohibition of commercial or professional use, a contractual penalty of €2,500 is agreed. Hadad GmbH may demand the full penalty only after multiple violations. Combining multiple acts into one legal entity is excluded. In addition to the penalty, Hadad GmbH may assert further claims for damages and exclude the user from future services.

Hadad GmbH has no influence over the rankings in the product results. The displayed results are based solely on the user's prior input.

For all disputes between the parties, regardless of the legal basis, Lehrte is agreed as the place of jurisdiction, provided the user is a merchant under the German Commercial Code, has no general place of jurisdiction in Germany, or relocates residence abroad after contract conclusion, or if the place of residence is unknown at the time of legal action. The contractual relationship is governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules of the EGBGB.

These General Terms and Conditions conclusively regulate the legal relationship between Hadad GmbH and the user. Amendments or supplements require written form to be valid, including any waiver of this written form clause. Amendments due to changes in legislation, case law, market conditions, or corporate structure will be notified in writing to existing customers. They are deemed approved unless the customer objects in writing within one month of notification. The provider will specifically highlight this consequence upon notification.

Should any provision of these Terms and Conditions, or part thereof, be invalid, this shall not affect the validity of the remaining provisions.
